Modernization of Law in the Company Interest
Head of Metafrax Group corporate and law division Margarita Belyakova on 29 June 2022 has participated in X Saint-Petersburg international law forum. She was a speaker of the session “Notary participation in corporate management: whether a business needs a notarial guardianship?”
The session was dedicated to the discussion of the notary element application perspectives in corporate legal relationships. The discussion participants were the RF Justice Minister deputy Maksim Beskhmelnitsyn, the deputy head of Russia FTS Vitaliy Kolesnikov, Federal notary chamber president Konstantin Korsik, Belarusian notary chamber chairman Natalya Borisenko, Moscow state law university named after О.E. Kutafin head Victor Blazheev.
The discussion participants discussed the notary role in the process of business protection and considered by what shall be guided a lawmaker when making a decision regarding implementation of mandatory notarization for corporate decisions.
Positive experience of the notary institution application in corporate life resulted in expansion of the notaries’ role. They participate during execution of the company cessation of membership, specific company decisions, notarization of the contracts of convertible loan and in other cases. Now the initiatives are being discusses, which are related to the further expansion of notary element in corporate legal relationships.
Inclusion of a notary in regulation of corporate legal relationships has allowed to increase comfort and speed during legal acts, as well as to decrease the business representatives costs. This is promoted as well by an extensive list of digital tools, which are available today for a notary. Many representatives of the business community highlight convenience and, as a consequence, high demand for such “digital” notary act as processing of the document from a hard copy to a soft one keeping it validity. This, for example, allows to forward the documents from Vladivostok to Moscow in a couple of minutes. “Such tools simplify the business practice and business life, and it’s very important”, noted Margarita Belyakova.

Anniversary Х Saint-Petersburg international law forum is the biggest platform for a dialogue between representatives of law, entrepreneur, politic and law enforcement communities in relation to the law issues. The forum was attended by 3 000 specialists from Russia and by 45 foreign states. The forum participants in the process of discussion related to issues of the law modernization in the company interest have tried to develop the unified approach to their solving in the modern world. The forum has become not just a platform for discussing best practices, but also a useful tool for the development of legal relations.
